Terms of Service

These Terms of Service ("Terms") govern your use of Domaination ("Domaination", "we", "us"), a domain name monitoring service. By using the service you agree to these Terms. If you do not agree, do not use the service.

1. The service

Domaination lets you search domain names, view their availability and registry status, and monitor unavailable domains so we can email you when they appear to become available. Availability and registry data come from public sources (RDAP and DNS) and are provided on a best-effort basis. We do not register, sell, or broker domains ourselves.

2. No guarantee

We do not guarantee that any domain will become available, that you will be able to register it, or that our notifications will reach you in time. Desirable domains are often registered within seconds of becoming available by automated drop-catching services. Monitoring is a best-effort attempt to inform you, not a guarantee of acquisition.

3. Accounts

You need an account to monitor domains. You are responsible for activity under your account and for keeping your login secure. Authentication is handled by our identity provider, Clerk.

4. Fees and payments

Your first monitored domain is free, once per account, for life. Each additional domain is a one-time fee of $2 USD ($1 for Pro members). Pro membership is a one-time $100 USD fee. The Make an Offer service is $29 USD per inquiry ($19 for Pro). Payments are processed by Stripe; we never store your card details.

To keep a domain monitored until it actually drops, we may automatically charge your saved payment method again when the domain's expiry date changes (for example, if the owner renews or the domain is re-registered). You can cancel monitoring of any domain at any time from your dashboard to stop future charges.

5. Refunds

One-time monitoring and inquiry fees are generally non-refundable once the service has been provided. If you believe you were charged in error, contact us and we will review it in good faith.

6. Affiliate links

When a domain is available we may show links to third-party registrars. Some of these are affiliate links, meaning we may earn a commission if you register through them, at no extra cost to you. You are free to register any domain wherever you choose.

7. Acceptable use

You agree not to misuse the service, including by attempting to overload, scrape, or disrupt it, or by using it for unlawful purposes. We may suspend or terminate accounts that violate these Terms.

8. Disclaimers and liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Domaination is not liable for any indirect, incidental, or consequential damages, or for any lost opportunity to register a domain. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you may have under the Australian Consumer Law that cannot lawfully be excluded.

9. Changes

We may update these Terms from time to time. Continued use of the service after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of Australia. Disputes are subject to the jurisdiction of the Australian courts.
